An Important Note to all our members: Please do not abuse the staff of the NSW Police Registry Unit. It is not their fault if the NSW Security Industry Act is falling apart. We have found the Registry staff to be quite helpful and polite. They are working under extremely difficult conditions and pressure. Be patient with them and tell them how much you appreciate their hard work.

They did not write the NSW Security Industry Act, the club members did--with the support of the Premier, the NSW Police Minister and the NSW Police Commissioner. If you are going to get angry, get angry with the politicians responsible for setting up a monopoly in the NSW Security Industry and the disgusting "jobs for  mates" state of affairs of our industry.

NSW Workplace Agreements

A "Workplace Agreement" under a State Award is called an "Enterprise Agreement". It is often used in the workplace instead of paying employees under the relevant State award: in our case, the Security Industry State Award.

The aim of such an agreement is to pay the employee at a flat rate, rather than pay different rates for different shifts.

What many people don't realise is that the annual wage should be the same as if the person had been paid under the award. It is not intended to be an alternative system which enables employers to pay employees less money or avoid the obligations or responsibilities which exist under the Award!

Another thing that people may not be aware of is that the Agreement must be approved and registered with the NSW Industrial Relations Commission. The agreement cannot be varied without the approval of the Commissioner.

(A company does not need to notify the Commissioner of new staff, unless that new staff member is mentioned by name in a new agreement. The Commissioner's approval must be sought for any other changes that affect the agreement.)

New staff must be made aware of the agreement, and must have access to it. It must be available in a language that they understand.

If you would like to find out more about Workplace Agreements, call the Department of Industrial Relations on 131628. They will be more than happy to forward information to you or answer any questions that you may have. Alternatively, you can look them up on the Internet http://www.dir.nsw.gov.au to find out more.

These Enterprise Agreements are based on the State award. If your company is covered by a Federal Award, then you need a "Certified Agreement". To find out if your company is covered by a Federal Award, you can call the Federal Department of Employment, Workplace Relations and Small Business on 02-9282 0888.
